Tom Petty’s daughters from his first marriage have filed a lawsuit in Los Angeles Superior Court against his widow, Dana York Petty, seeking control of the late artist’s estate.
Adria Petty and Annakim Violette Petty have alleged that Dana York Petty is depriving them of their rights with regard to the release of Petty’s works.
Interpreting the terms of the trust Petty Unlimited LLC that entitle them to “equal participation” in decisions about how the catalog is exploited, Adria and Violette are now seeking two votes out of three and thus majority control over Petty’s catalog.
They have sought at least $5 million in damages from Dana in addition to recovery of Petty’s assets and the establishment of a “constructive trust” in their favor over all assets “wrongfully” in the defendants’ possession.
In April this year, Dana sought to entrust the catalog with a professional manager, citing difficulty in orderly conduct of business due to Adria’s erratic and abusive nature.
The new lawsuit filed through attorney Alex Weingarten, alleges Dana set up a separate LLC, Tom Petty Legacy, “as a vehicle through which to deprive” Petty Unlimited of those assets.
The suit also alleges that a few others, including Lawrence N. Jenkins, Anthony , Alan Arora and Entertainment LLC, worked “in conjunction with” Dana to achieve this.
Dana’s attorney Adam Streisand called the suit “destructive nonsense.”
Petty died in October 2017 of an accidental drug overdose.
